Professor's research cited in recent SCC decision
Professor Jennifer Koshan's research on a specialized domestic violence court was cited in the Supreme Court of Canada decision R. v. Penunsi.
Jennifer co-authored the paper with Leslie Tutty “Calgary’s Specialized Domestic Violence Court: An Evaluation of a Unique Model” in the Alberta Law Review in 2013. The article is cited for the point that peace bonds are "an important tool used to protect women leaving abusive relationships."
According to The Lawyer's Daily, the decision settles a dispute among appellate courts and overturns a Newfoundland and Labrador Court of Appeal ruling which held last year that the judicial interim release (a.k.a. bail) provisions in s. 515 of the Criminal Code (contained in Part XVI of the Criminal Code) do not apply to the peace bond provisions in s. 810.
